Depends on what he said/did. The Constitution guarantees the right to speak freely (within limits, you can't yell,"Fire!" in a crowded Theater for example).

What created the scene was the police movement against him and his screaming as a result. The kid was asking a question... and personally, I think the police freaked out.
Kerry probably would have embarressed him anyway... and I don't even LIKE Kerry, but if you go around asking about Skull and Bones, you're just asking to get made fun of.

Security made a move only after they had REPEADATLY asked him to step away. He gave them some snotty remarks, so they finally cut his mic. And he still wouldn't move. So obviously force had to be used.

He asked a stupid question. He'll get a stupid answer.
There was no reason for police to get involved. Their interference (I believe) lead to that fiasco.
